Kismet - Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Kismet application ("App") developed by MobilBoyut ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Kismet, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the App.

2. Description of Service

Kismet is an AI-powered coffee fortune reading application. Users can take photos of their coffee cups and receive AI-generated fortune readings. The App is available as a freemium product with in-app credit purchases for fortune readings.

3. Entertainment Disclaimer

Kismet is an entertainment application only. Fortune readings generated by the App are produced by artificial intelligence and are intended solely for entertainment purposes. They should not be considered as professional advice of any kind (financial, medical, legal, psychological, or otherwise). We make no claims regarding the accuracy or predictive value of the readings.

4. Account and Authentication

• You must verify your phone number via SMS OTP to create an account.
• You may also sign in using Google or Facebook.
• You are responsible for maintaining the security of your account.
• You must provide accurate information during registration.
• You may not create multiple accounts or use another person's account.

5. Use of the App

You agree to use Kismet only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations.
• Attempt to reverse engineer, decompile, or disassemble any part of the App.
• Upload inappropriate, offensive, or illegal content as coffee cup photos.
• Abuse the AI system by submitting content that is not related to coffee fortune reading.
• Attempt to manipulate or exploit the credit system.
• Use the App to harass, abuse, or harm others.

6. Credits and In-App Purchases

• Fortune readings require credits, which can be purchased through the App.
• All purchases are processed by Google Play and are subject to Google Play's Terms of Service.
• Purchased credits are non-refundable except as required by applicable law or Google Play's refund policy.
• Credits have no monetary value and cannot be exchanged for cash.
• We reserve the right to modify credit pricing and packages at any time.

7. Content and Intellectual Property

• All content, design, graphics, and code within Kismet are the property of MobilBoyut and are protected by applicable intellectual property laws.
• Fortune readings generated for you are for your personal use only.
• You retain ownership of photos you upload, but grant us a limited license to process them for fortune reading purposes.
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. User Content

By uploading photos to Kismet, you represent that:

• You have the right to share the photos.
• The photos do not contain inappropriate, illegal, or harmful content.
• The photos do not infringe on any third party's rights.

We reserve the right to remove any content that violates these Terms.

9. Disclaimer of Warranties

Kismet is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, uninterrupted, or free of harmful components. AI-generated fortune readings are for entertainment only and carry no guarantee of accuracy.

10. Limitation of Liability

To the maximum extent permitted by law, MobilBoyut shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of credits, or any decisions made based on fortune readings.

11. Third-Party Services

Kismet integrates with third-party services including Google Play Billing, Firebase, Anthropic Claude AI, Google Sign-In, and Facebook Login. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.

12. Termination

We reserve the right to terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, unused credits may be forfeited.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected on this page with an updated date. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
